These Terms of Service ("Terms") govern your access to and use of GenShapr ("GenShapr" or the "Service"), operated by Century Shift, LLC, an Illinois limited liability company ("we", "us", or "our").

By accessing or using https://genshapr.com, creating an account, or using any part of the Service, you agree to be bound by these Terms. If you do not agree, do not use GenShapr.

1. Eligibility

You must be at least 13 years old (or 16 in certain jurisdictions) to use GenShapr.

If you are using GenShapr on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

You agree to provide accurate, current, and complete information and to keep it updated.

3. Acceptable Use

You agree not to use GenShapr to:

• Upload or generate illegal, harmful, abusive, defamatory, or infringing content
• Infringe intellectual property rights
• Reverse-engineer, scrape, probe, or disrupt the Service
• Use bots or automated systems without written permission
• Circumvent rate limits, security, or access controls
• Violate any applicable law or regulation

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Your Content

You retain ownership of content you upload.

By uploading content, you grant us a limited, non-exclusive, royalty-free license to store, process, and display your content solely to operate and improve the Service.

You represent and warrant that:

• You have all necessary rights to upload the content
• The content does not infringe any third-party rights

We do not claim ownership of generated 3D models produced from your content.

5. 3D Printing & Manufacturing Disclaimer

GenShapr generates digital 3D models intended for fabrication. You are solely responsible for:

• Verifying dimensions and structural integrity
• Selecting appropriate materials
• Ensuring food safety compliance where applicable
• Ensuring compliance with local manufacturing regulations

We do not guarantee that generated files are suitable for printing, food contact, commercial resale, or any specific purpose.

Use of generated files is at your own risk.

6. Subscriptions & Payments

Certain features require a paid subscription.

• Fees are billed in advance (monthly or annually).
• Payments are processed by Stripe, Inc.
• You authorize recurring charges until cancellation.
• Cancellation takes effect at the end of the billing period.
• Fees are non-refundable except as required by law.

We may change pricing with reasonable advance notice.

Failure to pay may result in suspension or termination.

7. Intellectual Property

GenShapr, including its software, algorithms, interface design, branding, and trademarks, are owned by Century Shift, LLC or its licensors.

No rights are granted except as expressly stated in these Terms.

You may not use our name, logo, or branding without written permission.

8. Copyright & DMCA Policy

GenShapr allows users to upload and store content privately within their accounts. We do not publicly display user content. However, we respect intellectual property rights and expect our users to do the same.

If you believe that content stored on GenShapr infringes your copyright, you may submit a notice to:

Your notice must include:

• A description of the copyrighted work claimed to have been infringed
• A description of the allegedly infringing material sufficient for us to locate it (such as the account email or specific file name, if known)
• Your name, address, email address, and telephone number
• A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
• A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf
• Your physical or electronic signature

Upon receiving a valid notice, we may:

• Remove or disable access to the allegedly infringing content
• Notify the affected user
• Suspend or terminate repeat infringers

We reserve the right to remove content that we believe violates intellectual property laws or these Terms.

9. Disclaimer of Warranties

GenShapr is provided "as is" and "as available."

We disclaim all warranties, express or implied, including:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Availability or uninterrupted operation

We do not guarantee error-free operation or that defects will be corrected.

10. Limitation of Liability

To the maximum extent permitted by law:

Century Shift, LLC and its affiliates shall not be liable for indirect, incidental, special, consequential, or punitive damages.

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Century Shift, LLC from any claims, damages, or expenses (including attorneys' fees) arising from:

• Your content
• Your use of the Service
• Your violation of these Terms

12. Termination

We may suspend or terminate your access at any time for violation of these Terms or other lawful reasons.

You may terminate your account at any time by contacting [email protected].

Upon termination:

• Your access ceases immediately
• We may delete stored content after a reasonable retention period

13. Export Compliance

You agree not to use or access the Service in violation of U.S. export laws or sanctions regulations.

14. Governing Law

These Terms are governed by the laws of the State of Illinois, United States.

Any disputes shall be resolved in the state or federal courts located in Illinois.

15. Changes to These Terms

We may update these Terms from time to time.

Material changes will be communicated via email or in-app notice.

Continued use after changes take effect constitutes acceptance.
